Why is The Great Indian Kapil Show in trouble?

Phonographic Performance Ltd (PPL) India moved Bombay HC against The Great Indian Kapil Show. The makers are charged with unauthorized use of three songs - M Bole Toh from Munna Bhai MBBS (2003), Rama Re from Kaante (2002) and Subah Hone Na De from Desi Boyz (2011). The songs were used in the third season of the show.

PPL India has claimed these uses amount to ‘public performance/communication to the public’ under the Copyright Act, 1957, requiring a licence from the rights holder. Stating that no such licence was either sought or granted, it accused K9 Films Pvt Ltd and BeingU Studios Pvt Ltd, the production houses behind the show, of copyright infringement.

This included three episodes which were aired between June 21 and September 20. The first featured actors Sidharth Malhotra and Janhvi Kapoor while promoting their movie Param Sundari. The episode featured M Bole To. Another episode played the track Rama Re, while the final episode with Akshay Kumar played the song Subah Hone Na De from his own movie, Desi Boyz.
